Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Marine Tracker mobile application (the “App”), provided by Marine Tracker (“we”, “us”, “our”). By downloading, installing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. The service

Marine Tracker provides live vessel tracking based on AIS (Automatic Identification System) data, vessel search, port and lighthouse databases, a marine compass, and related features (the “Service”). The Service is offered on a freemium basis: a free, ad-supported tier, and a paid subscription tier, Marine Tracker Pro, described in Section 4.

2. Not for navigational use

Marine Tracker is provided for informational and recreational purposes only. It is not a certified navigational aid and must not be used for the navigation, operation, or safety management of any vessel, aircraft or vehicle. AIS data depends on equipment carried and correctly configured by third-party vessels, and on network and satellite coverage outside our control. Positions, headings, speeds, ETAs and other vessel data may be delayed, incomplete, inaccurate, or entirely unavailable for a given vessel at a given time. Always rely on official nautical charts, radar, and certified navigational equipment for any decision affecting safety of life, vessels, or cargo at sea.

3. Eligibility

You must be able to form a binding contract to use the App. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Marine Tracker Pro & subscriptions

  • What’s included: Marine Tracker Pro removes ads and unlocks premium features including weather overlays, AI vessel summaries, port arrival/departure alerts, and full unblurred data fields.
  • Billing: subscriptions are billed through Google Play or the Apple App Store, at the price and interval shown at the time of purchase. Payment is charged to your store account at confirmation of purchase.
  • Auto-renewal: subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Manage or cancel your subscription through your Google Play or App Store account settings — we cannot cancel it on your behalf.
  • Free trials & introductory offers: where offered, any unused portion of a free trial is forfeited when you purchase a subscription, as applicable.
  • Refunds: refund requests are handled by Google Play or the Apple App Store under their respective policies. We do not process payments or refunds directly.
  • Price changes: we may change subscription pricing; where required, we will notify you in advance and any change will apply only to subsequent billing periods.

5. Acceptable use

You agree not to:

  • Reverse engineer, decompile, or attempt to extract the source code of the App, except where applicable law expressly permits it.
  • Use automated means (bots, scrapers) to extract vessel, port or lighthouse data from the App or its backend at scale.
  • Use the Service to stalk, harass, or endanger any individual or vessel crew.
  • Interfere with or disrupt the App’s infrastructure, or attempt to bypass subscription entitlement checks or advertising.
  • Use the Service for any unlawful purpose or in violation of any applicable maritime, export, or trade regulation.

6. Intellectual property

The App, its design, branding, and underlying software are owned by Marine Tracker or its licensors and protected by intellectual property laws. Vessel, port and lighthouse data displayed in the App is licensed from third-party providers and may not be extracted, resold, or redistributed outside the App. We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes, subject to these Terms.

7. Advertising

Free-tier use of the App includes advertising served through Google AdMob. Ads may be personalized based on your consent choices and platform settings. Upgrading to Marine Tracker Pro removes advertising.

8. Third-party data & services

Vessel positions are sourced from a third-party AIS data provider; weather overlays from OpenWeatherMap; AI vessel summaries from OpenAI. We do not control, and are not responsible for, the accuracy, availability, or content of these third-party data sources. Their inclusion in the App does not constitute an endorsement.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT VESSEL, PORT OR LIGHTHOUSE DATA WILL BE ACCURATE OR CURRENT AT ANY GIVEN MOMENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARINE TRACKER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, GOODWILL, VESSEL, CARGO, OR LIFE, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE — INCLUDING ANY RELIANCE ON VESSEL TRACKING DATA FOR NAVIGATIONAL OR SAFETY PURPOSES, WHICH IS EXPRESSLY PROHIBITED UNDER SECTION 2. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR USD $20 IF YOU HAVE NOT MADE ANY PAYMENT.

11. Termination

We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the App and uninstall it at any time; this does not automatically cancel an active subscription, which must be canceled through your Google Play or App Store account.

12. Changes to these Terms

We may update these Terms from time to time. Continued use of the App after an update constitutes acceptance of the revised Terms. Material changes will be reflected by updating the “last updated” date above.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which Marine Tracker is established, without regard to conflict of law principles, except where local consumer protection law requires otherwise.
